당내경선 여론조사 시, 당원 여부 거짓 응답 권유한 혐의

SNS 단체방에 게시물 작성…선관위 “민의 왜곡 불법행위 엄정 대응”

대덕구선거관리위원회는 제9회 전국동시지방선거 당내경선 여론조사와 관련해 거짓 응답을 권유·유도한 혐의로 A 씨를 11일 대덕경찰서에 고발했다고 밝혔다. 

선거의 공정성을 훼손하는 여론조사 부정행위에 대해 선관위가 강력한 사법 조치에 나선 것이다.

선관위에 따르면 A 씨는 지난 4월 중순 실시된 B 정당 구청장 선거 당내경선 과정에서 경선 후보자 C 씨의 지지자들이 모인 카카오톡 오픈채팅방에 여론 왜곡을 목적으로 한 글을 게시한 혐의를 받고 있다.

A 씨는 해당 채팅방에서 여론조사 전화를 받을 때 당원 여부를 사실과 다르게 응답하도록 권유하고 유도하는 내용을 작성·게시하여 경선 결과에 부당한 영향을 미치려 한 것으로 보고 있다.

현행 공직선거법 제108조 제11항 제1호에 따르면, 누구든지 당내경선을 위한 여론조사 결과에 영향을 미치게 하기 위해 다수의 선거구민을 대상으로 성별, 연령 등을 거짓으로 응답하도록 지시하거나 권유·유도하는 행위를 할 수 없다. 

이를 위반할 경우 같은 법 제256조에 따라 3년 이하의 징역 또는 600만 원 이하의 벌금에 처해질 수 있다.

대전선관위 관계자는 공정한 선거 질서 확립을 위해 민의를 왜곡하는 불법 행위에 대해 엄정하게 대응할 방침이라고 강조했다.

An official from the Daejeon Election Commission emphasized that the commission plans to respond strictly to illegal acts that distort the will of the people in order to establish a fair election order.
