장철민 더불어민주당 국회의원(대전 동구)이 인공지능(AI) 기술 확산 현실을 반영해 선거운동 규제를 합리화하는 내용의 '공직선거법 일부개정법률안'을 9일 대표 발의했다고 밝혔다.

현행 공직선거법은 선거일 90일 전부터 선거일까지 AI를 활용한 이미지·음성·영상 제작 및 게시를 금지하고 있으며, 선거운동 홍보물에도 AI 활용 사실을 명시하도록 규정하고 있다. 

그러나 AI 기술이 생활 속에 폭넓게 도입된 상황에서 이러한 조항이 과도한 규제로 작용하고, 오는 22일 시행되는 '인공지능기본법'과 중복된다는 지적이 제기돼 왔다.

개정안은 허위 정보를 사실처럼 오인하게 만드는 ‘딥페이크’ 영상 제작은 엄격히 금지하되, 일반적인 선거홍보물 제작에 AI를 활용하는 것은 허용하도록 규제 체계를 조정하는 것이 핵심이다. 

또한 기존에 부과된 ‘AI 이용 표시 의무’ 조항을 삭제해 인공지능 관련 규제를 '인공지능기본법' 하에서 통합적으로 관리하도록 했다.

장 의원은 “AI가 이미 영상, 음성 등 다양한 영역에서 손쉽게 쓰이는 현실에서 선거홍보물마다 기술 사용 여부를 구분·표시하는 것은 비현실적”이라며 “허위·기만 목적의 딥페이크는 철저히 차단하되, 기술 발전과 표현의 자유를 동시에 보장하기 위한 최소한의 합리적 제도 정비가 필요하다”고 말했다.

그는 이어 “AI 관련 기본법이 시행되는 현 시점에서 선거 분야의 중복 규제를 정비해야 법 체계의 정합성이 높아진다”며 “기술 변화에 발맞춘 합리적인 선거 제도 논의를 국회 차원에서 지속해 나가겠다”고 덧붙였다.

한편 장철민 의원은 이번 개정안 발의와 함께 AI를 직접 정치 소통에 활용하기도 했다. 

지난 6일 자신의 출마선언문을 기반으로 한 AI 음원 콘텐츠를 제작해 유튜브 채널에 공개했으며, 현행 규정에 따라 AI 활용 사실을 명시했다. 

그는 “AI는 두려움의 대상이 아니라 책임 있는 기준 속에서 활용할 도구임을 보여주고 싶었다”며 이번 법안의 취지를 강조했다.

National Assemblyman Jang Cheol-min: "Allow AI-Based Election Campaigning, But Ban Deepfakes"

Jang Cheol-min, a Democratic Party member of the National Assembly (Daejeon Dong-gu), announced on the 9th that he had introduced a bill to amend the Public Official Election Act, which aims to rationalize election campaign regulations by reflecting the proliferation of artificial intelligence (AI) technology.

The current Public Official Election Act prohibits the production and posting of images, audio, and videos using AI from 90 days before the election until the day of the election. It also requires that campaign materials clearly state the use of AI.

However, given the widespread adoption of AI technology in everyday life, some have criticized this provision as excessive regulation and argue that it overlaps with the Framework Act on Artificial Intelligence, which takes effect on the 22nd.

The core of the amendment is to strictly prohibit the production of "deepfake" videos, which mislead people into believing false information is true, while allowing the use of AI in general election campaign materials.

Furthermore, the existing "mandatory AI usage indication" provision was removed, allowing for integrated management of AI-related regulations under the Framework Act on Artificial Intelligence.

Representative Jang stated, "Given that AI is already readily used in diverse areas, including video and audio, it is unrealistic to distinguish and indicate the use of this technology in every campaign material." He added, "While deepfakes intended for false or deceptive purposes must be thoroughly blocked, a minimum level of reasonable institutional reform is necessary to simultaneously guarantee technological advancement and freedom of expression."

He continued, "With the implementation of the Framework Act on AI, overlapping regulations in the election sector must be reorganized to enhance the consistency of the legal system. I will continue to discuss a reasonable election system that keeps pace with technological changes at the National Assembly level."

Meanwhile, Representative Jang Cheol-min has also directly utilized AI for political communication, in conjunction with the introduction of this amendment.

On the 6th, he produced AI audio content based on his candidacy declaration and released it on his YouTube channel, clearly stating the use of AI in accordance with current regulations.

He emphasized the purpose of this bill, saying, “I wanted to show that AI is not an object of fear, but a tool to be used within responsible standards.”
