더불어민주당 장철민 의원(대전 동구)은 11일 탄핵소추로 직무가 정지된 공무원의 보수 지급을 전면 중단하는 내용을 담은 ‘국가공무원법 일부개정법률안’을 재발의했다고 밝혔다. 

이 법안은 2023년 이상민 전 행안부 장관의 탄핵 당시 발의되었으나, 제21대 국회 임기 만료로 폐기된 바 있다. 

최근 12.3 내란 사태로 대통령 및 고위 공무원의 직무 정지가 예상됨에 따라 제도 개선의 시급성이 더욱 부각되고 있다.

현행법상 탄핵소추된 공무원은 헌법재판소의 최종 판결이 있을 때까지 직무는 정지되지만, 보수는 그대로 지급받는 특혜를 누리고 있다. 

이는 일반 공무원이 정직 처분을 받을 경우 해당 기간 동안 보수가 전액 감액되는 것과 대조된다.

장 의원이 발의한 이번 개정안은 탄핵소추 의결을 받은 공무원의 권한 행사 정지 기간 동안 보수를 전액 감액하도록 규정하고 있다. 이를 통해 공직사회의 책임성을 강화하고 제도의 일관성을 확보할 수 있을 것으로 기대된다.

장철민 의원은 “내란 사태의 주범들이 국민의 혈세로 월급을 받는 것은 민주주의에 대한 모독”이라며, “탄핵소추된 자가 아무런 일도 하지 않으면서 거액의 급여를 받는 것은 우리의 정서상 용납되기 어렵다”고 강조했다. 

이어 “무노동 무임금 원칙을 고위 공무원에게도 동일하게 적용해 형평성을 바로잡아가겠다”고 덧붙였다.

Rep. Jang Cheol-min, ‘Salary Suspension in Case of Impeachment’ Civil Servant Act Reintroduced

Rep. Jang Cheol-min (Daejeon Dong-gu) of the Democratic Party of Korea announced on the 11th that he has reintroduced the ‘Partial Amendment to the National Civil Servant Act’ that includes a provision to completely suspend the salary of civil servants suspended from their duties due to impeachment.

This bill was proposed in 2023 when former Minister of Public Administration and Security Lee Sang-min was impeached, but was scrapped due to the expiration of the 21st National Assembly term.

The urgency of institutional improvement is further highlighted as the suspension of the president and high-ranking civil servants from their duties is expected due to the recent 12.3 civil rebellion.

Under the current law, civil servants who are impeached are suspended from their duties until the final ruling of the Constitutional Court, but they enjoy the privilege of receiving their salary as is.

This is in contrast to the fact that general civil servants receive a full salary reduction during the suspension period.

The amendment proposed by Rep. Jang stipulates that public officials who have been impeached will have their salaries completely reduced during the period of suspension from exercising their authority. This is expected to strengthen the accountability of the public service society and secure consistency in the system.

Rep. Jang Cheol-min emphasized, “It is an insult to democracy for the main perpetrators of the internal rebellion to receive salaries paid by the people’s tax money,” and “It is difficult to accept from our emotions that an impeached person receives a large salary without doing any work.”

He added, “We will apply the no-work, no-pay principle equally to high-ranking public officials to correct fairness.”
