학부모의 악성 민원에 시달리다 40대의 젊은 나이에 생을 마감한 故대전용산초 교사에 대해 해당 학부로 지목된 2명의 학부모들이 해당 교사를 상대로 16회의 민원을 제기 했던 것으로 조사됐다.

이와 관련 대전시교육청은 지난 9월 7일 고인이 된 대전용산초등학교 교사와 관련하여 의혹을 해소하고 진상을 규명하고자 9월 11일부터 22일까지 3개 부서 총 7명의 진상조사반을 구성하여 고인의 전·현 근무지 관리자 및 동료교사를 대상으로 진상조사 결과를 27일 발표했다.

대전시교육청의 이번 조사는 고인과 관련하여 학부모의 악성 민원 제기 여부 ,학교교권보호위원회 미개최 여부 ,악성민원에 대한 관리자 회유 및 소극대응 여부 등에 대해 조사했다. 

대전시교육청이 밝힌 조사결과 고인에 대해 학부모 2명은 2019년부터 2022년까지 4년 동안, 국민신문고 7회, 방문 4회, 전화 3회, 아동학대 및 학폭위 신고 각각 1회 등 총 16차례의 민원(2019학년도 12회, 2020~2021학년도 각 1회, 2022학년도 2회 (학부모 2명 각각 13회, 3회))을 제기한 것으로 나타났다.

조사결과 이들 학부모들은 지난 2019년 5월과 10월에 학교에 방문하여 고인의 생활지도에 대해 불만을 품고 “내년도에는 같은 학년이나 담임을 배제해달라, 본인의 자녀에게 사과를 하라”고 요구하는 등 수차례 민원을 제기하여 고인의 전반적인 교육활동을 위축시키는 결과를 초래하였고, 똑 같은 민원으로 11월 말 3일 연속 5차례 민원을 제기한 후 인접한 날짜인 12월초 아동학대 신고와 학교폭력자치위원회 신고를 동시에 하여 고인으로 하여금 짧은 시기에 극심한 심리적 압박을 받게 했다고 대전시교육청은 밝혔다.

특히 이들 학부모들은 2020년 10월 고인의 아동학대 혐의에 대해 검찰이 ‘혐의없음’을 결정했음에도, 2021년 4월 및 2022년 3월 각각 아동학대 무혐의 처분에 대해 인정 못한다는 이유로 민원을 제기하여 고인에게 트라우마를 일으키는 등 반복적인 민원을 제기했다고 대전시교육청이 밝혔다.

이에 따라 대전시교육청은 반복적인 민원 제기로 고인은 심리적으로 상당한 위축을 받아 정상적인 교육활동을 침해받은 것으로 확인된 바, 민원을 제기하고 부적절한 발언을 한 해당 학부모 2명에 대해, 수사기관에 공무집행방해 등의 혐의로 수사 의뢰를 할 뜻임을 밝혔다.

학교 대응의 적정여부에 대해서는 관리자 및 동료 교사 등을 통해 조사를 실시하였고, 특히, 학교교권보호위원회 미개최 의혹에 대한 조사결과 2019년 11월말 두차례에 걸쳐 구두로 학교교권보호위원회 개최를 요청한 사실이 있으나, 관리자는 고인에게 관련 자료를 제출토록 요구만하고 고인으로부터 관련 자료 제출이 없자 학교교권보호위원회를 미개최하였으며, 지속적으로 악성 민원이 제기되는 상황에서도 2019년 12월부터 2022학년도까지도 학교교권보호위원회를 개최한 사실이 없는 것으로 확인하였다.

대전시교육청은 학교 관리자의 소극적 민원 대응 의혹에 대한 조사결과도 발표했다.

교육청은 고인의 정당한 교육활동에 대해 부당한 간섭의 민원을 16차례 반복 제기한 것은 고인의 교육활동에 대한 중대한 침해 행위에 해당되므로, ‘교원 지위법’제15조에 따라 학교장은 즉시 교육활동 침해행위로 피해를 입은 교원의 치유는 물론 학교교권보호위원회 개최 등 교권 회복에 필요한 조치를 하여야 함에도, 민원 재발 방지에 적극적 대응없이 2019년 11월 학부모의 지속적 사과요청에 대해 민원 확대를 우려하여 소극적으로 응대한 것으로 나타났다.

특히, 고인에 대한 안전조치, 해당 보호자 접촉 최소화, 학교교권보호위원회 개최 등 치유지원 및 교권 회복에 대한 조치가 미흡했던 것을 확인했다고 교육청이 밝혔다.

감사관은 이날 관리자는 교육활동 중에 발생하는 민원으로부터 교원을 보호함으로써 교원이 그 직무를 안정되게 수행할 수 있도록 하여야 함에도 위와 같이 관리자의 미흡한 대처행위는 ‘교육공무원법’성실 의무 등에 위배되므로, 학교 관리자 등 관련자에 대해서는 징계 등 조치를 취할 예정이라며 징계를 시사했다.
