[Rep. Jin-Seok Moon promotes the introduction of the collective building management system]

In order to increase the effectiveness of the settlement of disputes on collective buildings by National Assemblyman Moon Jin-seok (the Democratic Party of Korea, Cheonan-gap, Chungnam), the 「Act on Ownership and Management of Collective Buildings」 is based on the establishment of investigation rights by local governments, mandatory participation in the mediation committee, and the collective building management business system. On the 8th, some amendments were proposed.

A collective building refers to a building in which one building can be used as several independent buildings that are divided structurally, including multi-family houses, officetels, residential and commercial complexes, and shopping centers.

However, it is difficult to mediate disputes in case of civil complaints as the regulations on management of collective buildings are not clear. In particular, a total of 973 complaints related to collective buildings from 2016 to 2018, of which 86%, or 835, were requests for investigation or supervision by administrative agencies. Under the current law, public officials have the authority to conduct investigations and inspections for apartment houses, but local governments do not have the authority to supervise and supervise complex buildings, so dispute resolution is limited.

In addition, unlike apartment houses that are entrusted and managed by a housing management company registered in the local government, there is no regulation for registration of a management company, so problems such as excessive imposition of management fees by insolvent management companies and non-disclosure of details continue to occur.

This amendment requires local governments to request data from the management of a collective building, or to investigate and inspect related documents, and in the event of a dispute, compulsory responding to the mediation of the City/Do's Assembly Building Dispute Mediation Committee. In addition, it contains the contents of the establishment of a collective building management business system and legally stipulating the obligation to take over management tasks.
