Chungnam Provincial Council Urges Enactment of ‘Local Council Act’ to Guarantee Independence of Local Councils
The Chungnam Provincial Council has called for the swift passage of the ‘Local Council Act’ by the National Assembly to ensure the substantive independence, autonomy, and accountability of local councils.
The Chungnam Provincial Council announced that at the 3rd plenary session of the 371st extraordinary session held on the 3rd, it finally adopted the ‘Proposal Urging the Prompt Enactment of the Local Council Act,’ which was introduced by Representative Lee Ji-yoon (Asan 5, Democratic Party of Korea) and co-sponsored by 20 fellow council members.
This proposal was pursued to establish an independent legal and institutional framework that enables local councils, as representative bodies of residents and autonomous legislative bodies, to effectively check and monitor the executive branch and proactively identify policies necessary for the region. Although the complete revision of the Local Autonomy Act in 2021 established the independence of personnel authority for council administrative staff and introduced specialized policy support personnel, criticism has persisted in the field that the autonomy of organizational structure and personnel management, as well as the independence of budget formulation, remain lacking.
Through a proposal, the Chungnam Provincial Council demanded that the government and the National Assembly guarantee substantive autonomous organizational authority tailored to regional characteristics, expand a specialized legislative support system to strengthen legislative, policy, and budget analysis, and secure budget formulation authority and autonomy independent from the executive branch. Along with this, the council emphasized the need to establish institutional mechanisms to strictly refine ethical accountability to live up to these strengthened authority.
Councilor Lee Ji-yoon, who spearheaded the proposal, pointed out, "Even if personnel authority is independent, it cannot be considered complete independence if one cannot independently organize necessary bodies and deploy personnel." She added, "Substantive checks and balances cannot be achieved in a structure where even operational budgets remain under the influence of the executive branch." Representative Lee continued, "The enactment of the Local Council Act is not intended to grant privileges to individual council members, but is an essential task to strengthen the rights and interests of residents and enhance the democratic nature and accountability of local autonomy." He urged, "The 22nd National Assembly and the government must put an end to repetitive discussions and immediately proceed with the enactment of a bill that guarantees the right to organize autonomously and the independence of budget formulation."
Meanwhile, the proposal passed at today's plenary session is scheduled to be forwarded to relevant agencies, including the National Assembly and central government ministries.
