공모전 입상작으로 선정돼 상금을 받았어도 저작권은 저작권법에따라 공모전에 출품한 작가에게 저작권이 있는데도, 충남 공주시가 수년간 타인의 저작권을 내것 처럼 불법으로 귀속시킨 사실이 알려지면서 법질서를 스스로 부정했다는 지적을 받고 있다.

 

이같은 사실은 최근 만화 ‘검정 고무신’의 작가 이우영씨가 저작권 등 관련 송사로 이달 12일 스스로 목숨을 끊으면서 사회문제로 등장 한 저작권에 대한 관심이 높아지면서 알려졌다.

 

행정·공공기관의 각종 공모전 저작권 ‘불법 귀속’ 문제가 다시 주목 받으며 사회 이슈로 떠올랐다. 

 

특히 충남 공주시는 공모전을 개최하면서 공고문에  “저작권은 공주시에 귀속한다”고 적시해 스스로 위법행위를 한것으로 알려지면서 논란이되고 있다.

 

이는 현행법상 저작권은 창작자에게 있다는 사실을 위반한 것으로 , 그동안 언론과 정부의 개선요구에도 배째라식 대응을 한것이 아니냐는 지적을 받고있다.

 

취재결과 공주시가 지난 2021년부터 올해 3월까지 시행한 공모전은 대략 13~15건으로, 공주시는 이 가운데 9건에서 저작권을 공주시가 갖는다고 했다. 

 

공주시가 9건에 대해 저작권을 가저간것은 현행법상 불법이다. 

 

공주시는 이 가운데  2건에 대해서만 창작자에게 돌려준다고 표기했고, 일부는 저작권 소유주체 등을 명시하지 않았다.

 

현행법상 저작권은 창작자에게 있기때문에 공주시에서 저작권을 소유한것은 공주시가 법적 권한을 넘어섰다는  지적이다.

 

또 공모전이 입상자에게 일정한 상금을 지급하더라도 저작권의 소유주체 문제는 별개라는게 일반론으로 알려졌다.

 

저작물 활용 방식이나 추가 보상금 지급 등을 ‘협의’할 수는 있어도 작가의 저작권에는 변함이 없다는 것이다.

 

법규가 그런데도 공주시는 공모전 안내문을 통해 “선정작에 대한 저작권과 상표권 등 일체의 권리는 공주시에 귀속됨”(올해 1월 30일 고향사랑기부제 공모전) 등의 방식으로 저작권을 가져갔다.

 

이는 작가들의 공모전 입상이나 수상 실적이 절심함을 공주시가 역으로 이용한 것은 아닌지 공주시가 되돌아봐야 할 문제로 보인다.

 

또 작가들이  불법·불공정을 알면서도 응하는 이유는 입상 스펙이 절실해서 이기도 하지만 스스로가 저작권을 포기한 것은 아닌지에 대한 자성이 필요하다는 지적이다.

 

미술작가 A씨는 “뒤늦게 저작권 반환요청 소송을 하려 해도 시간과 비용이 너무 많이 들어 법적대응을 포기한다”고 어려움을 토로했다.

 

저작권과 관련 정부는 2014년 한국저작권위원회와 함께 ‘창작물 공모전 가이드라인’을 만들어 ‘저작권을 주최측이 갖는다’는 문구를 명시하지 못하도록 했다.

 

하지만 공주시는 저작권을 공주시가 갔겠다는 의지를 공모전에 공고문에 명시를 하면서 불법을 저질렀다.

 

정부는 가이드라인을 지자체에 보내면서  저작권법(10조), 디자인보호법(3조), 약관의 규제에 관한 법률(17조) 등을 함께 알려줬다.

 

2018년에는 공정거래위원회가 같은 내용을 고지했고, 2019년 1월에도 문화체육관광부가 '저작권 관리 지침'을 만들어 규정을 지키도록 했다.

 

같은해 12월에는 감사원까지 나서 '공공기관 불공정관행 규제점검'을 실시하며 행정기관의 '못된' 관행을 막았다.

 

하지만 공주시는 배짱 행정으로 힘없는 공모전 도전자들에게 저작권을 귀속시키도록 했다.

 

이에대해 공주시 관계자는 “규정을 눈여겨 보지 못한 측면이 있다. 앞으로 모든 공모전에는 저작권이 작가에게 있음을 명확하게 알리겠다”고 해명했다.
