더불어민주당 박영순 국회의원(대전 대덕)이 16일, 스토킹 범죄에 피해자보호명령제도를 도입하고, 긴급응급조치와 잠정조치 시 접근 금지의 대상을 직계 및 동거가족까지 확대하는 「스토킹범죄의 처벌 등에 관한 법률」 일부개정법률안을 대표 발의했다고 밝혔다.

박 의원이 발의한 개정안은 스토킹 범죄의 피해자 보호제도를 강화하고, 피해자뿐만 아니라 피해자의 가족까지 보호 대상을 확대하는 방안을 담고 있다.

최근 스토킹 범죄의 가해자가 신변보호 대상자의 자택에 찾아가 가족에게 흉기를 휘두르고 피해자의 가족을 살해하는 범죄까지 발생하는 등 스토킹범죄 처벌법이 시행된지 1년이 지났음에도 피해자 보호를 위한 조치가 아직도 미흡하다는 지적이 제기되고 있다.

박영순 의원은 이번 개정안을 통해 피해자보호명령제도를 도입하고 ,긴급응급조치 및 잠정조치의 보호대상을 피해자와 그의 직계동거가족으로 확대하고 ,이를 이행하지 않은 가해자를 처벌하는 규정을 담았다. 

박 의원이 발의한 개정안의 ‘피해자보호명령제도’란 피해자가 수사기관을 거치지 않고 법원에 직접 본인의 신변보호를 요청하는 제도이다. 현행법의 잠정조치는 사법경찰관 또는 검사가 필요 여부를 판단하여 법원에 청구하는 절차만 규정하고 있어 신고를 묵살하거나, 즉각적인 보호조치가 이뤄지지 않는 문제점이 있었다. 이번 개정안에 따라 피해자보호명령제도가 도입될 시 피해자 보호의 공백상황을 최소화 할 수 있을 것으로 기대된다.

박영순 의원은 “이번 법률안으로 스토킹 범죄의 피해자를 좀 더 세밀히 보호하고 이로 피해자가 안심하고 일상을 영위할 수 있는 사회를 만드는 계기가 되길 바란다”고 말했다.
