                               1. 제헌절의 역사적 의미와 유래
 

2022년 7월 17일은 제74년 제헌절이다. 제헌절은 삼일절, 광복절, 개천절, 한글날과 함께 대한민국 5대 국경일의 하나로 대한민국의 기본법인 헌법이 1948년 7월 17일에 제정·공포된 것을 기념하는 날이다. 제헌절은 1949년 10월 1일 국경일로 지정되어 국민들이 이 날 하루는 일을 하지 않고 휴식을 취할 수가 있었다. 그런데 주 5일 근무제 시행에 따라 휴일이 너무 많아지자 참여정부 국무회의가 지난 2008년부터 제헌절을 법정 공휴일에서 제외하자고 의결해서 지금은 5대 국경일 중 유일하게 공휴일이 아니다.

대한민국은 1945년 8월 15일 해방이 됐고, 미군정(3년)을 거쳤다. 1948년 5월 10일에 남한만의 단독 총선거로 국회의원 198명(제주도 2명은 선출 못 함)을 선출하고 5월 31일부터 제1대 국회가 개원됐다. 대한민국 국회는 자유민주국가의 기본법인 헌법을 제정하고 7월 17일에 자주독립의 떳떳한 민주국가임을 세계만방에 공포했다. 그리고 8월 15일에 새 헌법에 따라 대한민국 정부가 출범하게 됐다.
 

경성제국대학 3천재 중의 한 사람인 현민(玄民) 유진오(兪鎭午) 법학박사가 우리 헌법의 뿌리인 상해임시정부의 대한민국 임시헌장을 참고해 기초한 대한민국 제헌 헌법은 '대한민국 헌법 제1호'로 전문(前文)과 본문(本文) 10장 103조 구성되었다.
 

제헌 헌법은 전문에서 3·1 운동을 통해 대한민국을 건립한 독립정신을 계승한다고 규정하고 있다.
 

대한국 헌법 제1조를 보면 “대한민국은 민주공화국이다. 대한민국 주권은 국민에게 있고, 모든 권력은 국민으로부터 나온다.”고 규정되어 있다. 이는 대한민국이 대한제국까지 유지되어오던 왕정을 폐지하고 국민이 주인이 되는 민주공화정을 채택했음을 분명하게 보여주고 있다.
 

정부형태는 대통령제를, 국회는 단원제를 채택하고 있다. 대법원장은 대통령이 임명하지만, 국회의 승인이 필요하다.
 

대한민국은 자유민주주의 법치국가로 주권이 국민에게 있고 국민이 선출한 국회에서 헌법을 비롯한 각종 법률을 제정하고 그 법에 따라 대통령이 통치한다. 어떤 특권층이 자기 마음대로 통치할 수 없고 국가의 모든 국사는 법에 따라 처리되며 법은 모든 국민에게 평등하게 적용되고 있다.
 

우리는 법치주의 국가 국민으로서 제헌절을 맞이해 각 가정과 관공서, 단체에서는 태극기를 게양해야 한다. 그리고 선진국 국민으로서 긍지를 가지고 대한민국 헌법전문만이라도 한 번 읽어보고, 헌법정신을 창조적으로 계승 발전시키는 데에 앞장서야 한다.


                                  2. 헌법의 개념과 개헌 논의
 

헌법은 국가의 통치조직과 통치작용의 기본원리 및 국민의 기본권을 보장하는 근본 규범으로 실정법, 국내법, 공법, 실체법에 해당하며 모든 법의 근본이 되므로 모법(母法)이라고 한다. 그리하여 헌법은 자주 개정돼서는 안 되는데, 우리나라의 경우 최고 권력자인 대통령의 장기 집권욕과 군사 쿠데타와 당리당략에 의해 무려 9번이나 개정되어 문제가 되고 있다. 반면에 미국, 영국 등 선진국의 경우는 특별한 경우가 아니면 제헌헌법을 개정하지 않아 국민의 기본권이 잘 보장되고 있다.
 

그래도 준법정신이 투철한 우리 대한민국 국민은 민주주의를 수호하기 위한 시위와 촛불혁명을 통해 민주 헌법을 잘 지켜 왔다. 이제 국회가 여야 합의에 의해 법을 잘 제정하고 국민이 실정법을 잘 지켜 사회 질서와 안정을 기하는 것이 무엇보다 중요하다.
 

법보다 앞선 것은 도덕과 양심이다. 법이 없어도 사람이 해야 할 일은 하고 해서는 안 되는 것은 하지 않는다면 법은 자연이 잘 지켜지게 마련이다. 법은 어떤 몇몇 사람의 의견으로 만든 것이 아니고 다수 사람의 뜻을 모아 만든 것이기 때문에 법의 목적인 사회정의(social Justice) 실현에 대체로 부합해 다 같이 지켜나갈 의무가 있다.
 

준법정신은 그 나라 국민의 문화 수준을 나타내는 척도이다. 문화가 발달한 나라일수록 법을 잘 지킨다. 우리나라는 동방예의지국으로 예로부터 예절을 잘 지키는 문화민족으로 자랑해 왔다. 그러나 일부 몰지각한 시민들이 법을 잘 지키지 않아 사회혼란을 야기하는 경우가 종종 있어 사회문제가 되고 있다.
 

제헌헌법이 이제까지 9차례나 인위적으로 개정되는 과정에서 많이 훼손되었지만, 사회변화에 따라 새로 요구되는 시대정신이 반영되어 현행 헌법은 제헌헌법보다 현실 적합성이 비교적 높은 편이다.
 

그러나 현행헌법도 시공을 초월할 수는 없어, 앞으로 시대 변화에 따른 새로운 다양한 시대정신을 반영할 수 있도록 일부 개정할 필요성은 있다고 생각한다. 여기서 말하는 시대정신(Zeitgeist)이란 어떤 시대에 살고 있는 사람들의 보편적인 정신자세나 태도를 말하는 것으로 혁신, 정의, 안전, 인권, 상생, 평화 통일 등을 예로 들 수가 있다.
 

그런데 어떠한 경우에도 최고 권력자인 대통령이 정권을 연장할 목적으로 부당하게 헌법 개정을 하지 못하도록 국민들의 저항권을 강화할 필요성이 있다. 다행히도 우리 대한민국 국민들은 사회정의에 대한 욕구와 애국심이 강해 4·19혁명, 광주 민주화 운동, 6·10민주항쟁, 촛불혁명 등을 통해 저항권을 꾸준히 강화해 왔다.
                                  3. 제헌절 74주년의 과제
 

제헌절 74주년을 계기로 제헌헌법 정신을 창조적으로 계승 발전시키기 위해서는 학생, 일반 시민, 국가 공무원, 정치인, 군인들을 대상으로 학교교육과 사회교육을 통해 현장 중심의 법교육과 정치교육과 민주시민교육을 강화해 준법정신과 사회정의를 확립해야 한다. 특히 정치군인들이 쿠데타(military coup)로 정권을 잡아 자유, 평등, 인간의 존엄성을 중시하는 민주주의 정치를 후퇴시키는 사태가 또 다시 발생하지 않도록 특단의 대책을 마련해야 한다.

 

이를테면 민주 헌정을 유린한 독재정권의 인권탄압과 폭력에 맞서 저항하다가 부상을 당하거나 구속되어 가혹한 고문을 받다가 풀려나거나 목숨을 잃은 민주열사들에게는 보상과 포상을 하고, 헌정 질서를 파괴한 쿠데타와 내란 등을 통해 정권을 잡고 폭압적인 독재정치를 하여 인권을 유린하고 탄압한 반민주 행위자들을 찾아내 응분의 대가를 치르도록 법질서를 확립해야 한다.
 

제헌절 74주년을 맞이해 가장 강조하고 싶은 것은 일부 정치군인들이 정치 혼란을 틈타 쿠데타로 정권을 잡는 불행한 사태가 다시는 더 발생하지 않도록 국민저항권을 대폭 강화할 필요성이 있다고 생각한다. 그리고 국회가 비상계엄과 여야의 극한 대립으로 입법 기능을 제대로 수행하지 못할 경우에는 국민들이 국회의원을 소환하고 국회를 해산할 수 있는 권한을 주어야 한다고 생각한다.


                                4. 제헌절 74주년 경축행사
 

대한민국 국회는「대한민국헌법」제정을 기념하고 그 역사와 의미를 되새기기 위해 7월 17일 오전 10시 국회의사당 중앙홀에서 '제74주년 제헌절 경축식'을 개최했다.
 

제헌절 경축식에는 김진표 국회의장을 비롯해 김명수 대법원장, 유남석 헌법재판소장, 한덕수 국무총리, 노태악 중앙선거관리위원장 등 5부요인과 전직 국회의장, 여야 대표 및 원내대표, 국회의원, 입법·사법·행정부 주요 인사, 주한외교사절단, 헌정회원, 제헌국회의원유족회 등 400여 명이 참석했다.
 

경축식은 국민의례, 주제영상 상영, 감사패 수여, 헌정회장 기념사, 국회의장 경축사, 경축공연, 제헌절 노래 등의 순으로 진행되었다.
 

감사패는 의회민주주의 발전에 이바지한 김태룡 전 의원(제12대 국회의원)과 김일주 전 의원(제15대 국회의원)에게 수여되었다.
